District Attorney Larry Krasner admitted that his office could have pursued more rigorous prosecution against King earlier. The previous charges against King were related to an incident in January, partially captured in a viral video. The footage depicted King peering through windows and knocking while a person inside called for help.

Krasner explained that the case against King was dismissed because the victim failed to appear in court. King had managed to secure release by posting a 10% bail of $200,000. Krasner mentioned the strategic challenges faced when considering overnight appeals for higher bail.
